engine deposit question
I apologize in advance if this post is in the wrong section, but I couldn't see where else it might go.
In February 2007, I gave a deposit to Rebello racing to build an engine for my Z. Shortly after that, I was out of work and didn't get back to working until August. I was contacted last April and told that the engine was almost finished, at which time I told them that I wasn't working and couldn't afford to pay the other half. Dave said that he had a customer who had come in and ordered the same package as me, and told me that he could just sell that customer the engine he was building me. He said to contact him when I was ready and he could complete my engine build.
I have since fallen upon harder times. I had to sell the Z, and my wife is out of work. Unfortunately my job at the local BMW dealer doesn't pay much, and I know I won't be able to pay the rest of the job off in addition to not having a car to install it in. I contacted Rebello about getting my deposit back, and he said that he "usually doesn't do that" and that he'd "look into it and get back to me." That was two months ago. Anyone out there have any advice or suggestions on this? I was in a much different place financially when I started the project, and as much as I'd like to let it go, $2,000 is a lot of money. Any help is appreciated.

Did you sign a contract w/ them stating anything about the deposit being non-refundable? Did they end up selling your motor?
If there was no contract, and the motor has been sold, there's no reason for them to hold your deposit.
You should probably go talk to them in person. Be nice and understanding about it, but if they refuse, break out the WTF!??!?!?!?!??!

no sort of contract. I have nothing more than the receipt that reads "deposit on engine- $2000.00." No fine print or anything saying non refundable. I most likely will end up going there in person, but it won't be until after payday. Stupid $4 gas. . .
