Beware the Insurance-ator! They love our old cars because they get off cheap!! Nationwide just offered me $400 or we go to small claims court. Their policholder hit my 1983 TWICE and FLED. Broke tailight, dented rear fender, dented and jambed driver's door. They are saying the car can be fixed for $600 and that is more than 75% of it's value, therefore they only have to pay how much the damage has depreciated the salvage value. Watch out!

 

It entirely depends on your personal insurance policy, but your insurer may be able to help you on this one. If you've got collision and/or an assessed value on the car, or just a plain good agent, they often act as your attorney as part of their services to you. Then they rake the other driver's insurance and/or the driver over the coals until your claim, deductible, and the expenses are all covered. I've had good luck this way with my company. Of course, all that stuff changes over state lines or national boundaries, too. Sometimes you can go after the driver personally to cover expenses not covered by their insurance or yours (e.g. deductibles or shortfalls like you're seeing).
