Help

Anyone familiar with CA labor laws?
I was told today that as of monday i would not be working (laid off, right?) due to my employer tightening the belt. I was one week away from finishing a 3 month probationary period and now they are telling me i am on call with no promise or idea of when i "might" be working again.

Is this legal?

I wasnt fired so i cant get un-employment while job hunting. Im not working so i cant make any money. Are they using a legal loop hole to **** me over?

Im tired. So ****en tired. Cant seem to get a break in this life.

I'm not an expert, but a company is free to do whatever they want, within the first 90 days of employment, if they state that there is a "90 probationary employment period". Other than that, it is quite hard and expensive for Cali companies to get rid of employees after the 90 days.

that sucks man. is it a job that requires little training? i could see how the company would want to hire people at a lower rate for this three month period then let them go before they are due for a raise at the end of it. that sucks man.

on the real though, move out of the city. jobs are plenty over here. kinda. it's not crazy hard to get a decent one though and living is pretty cheap.

My real issue is them not fully letting me go. I need to be able to get unemployment but if they dont terminate me i cant, right? So they have me indefinately "on call". Thats my qualm. Aside from getting let go before i could finish my term . .****ers.

Unfortunately they are using a legal loop hole. By putting you on call, the eliminate the need to terminate you (by which makes them look like a better company for having a lower termination rate), but it keeps you from collecting unemployment. What you might want to do is call the unemployment office and see what you should do. Maybe voluntary quit wouldn't keep you from collecting unemployment. My company did a similar thing and I just voluntarily resigned and I have a phone interview with unemployment today. Good luck

This system is so jacked up. I didnt do anything wrong or try to pull some sort of scam. I am legally being screwed over. How is this ok and legal?! . . WTF . . and they wonder why people flip when they lose their jobs. You are ****ing with peoples lives. My life is now being ****ed with. No no, I aint going to do anything in retaliation but ****, it sure hurt my feelings . . .

you may be able to plea your case tho. i know i did with a situation up here. im gong to guess its prolly similar to california with rights of employees and such. is there a labour law website available to you?

Theres almost nothing you can do, I had the same problem right before I joined the army and basically was told that they are keeping the experienced people and that you can go **** yourself. Its a legally ok for them, as long as they are making money and are employed, they don't care about anyone but themselves.

sorry to hear that, dude.
in most states i've seen you qualify for unemployment based on the hours you're working. If the job is giving you less than 20 hours a week you SHOULD qualify (unless you haven't made enough to qualify) which you might not with only 3 months of employment. If you were laid off or had your hours cut you should qualify. if you quit or were fired you wouldn't.
